These Terms govern your purchase and use of the Xone:DB4 macOS driver (the “Software”) sold at donnydb4.com. The Software and this website are operated by Donny DB4 (“we”, “us”), a sole proprietorship based in Québec, Canada. By completing a purchase you agree to these Terms.

1. What the Software is

The Software is an independent, user-space macOS audio and MIDI driver for the Allen & Heath Xone:DB4 mixer. It is not an official Allen & Heath, Ploytec or Apple product and is not affiliated with, endorsed by or sponsored by any of them. Product and company names are used for identification only.

The Software installs a Core Audio HAL plug-in, a small helper program and a login item on your Mac, and restarts the macOS audio service during installation. It is designed for macOS 11 or later on Apple Silicon or Intel Macs, with a Xone:DB4 on firmware 1.4.x. An uninstaller is included.

2. Licence

On payment we grant you a personal, worldwide, non-exclusive, non-transferable, revocable licence to install and use the Software on Mac computers that you own or control, for as long as these Terms are met. You may keep and re-download your copy.

You may not resell, rent, sublicense or redistribute the Software, present it as your own work, or remove any notices. The Software includes third-party components licensed under the MIT licence (see the LICENSE file in the download and the credits on the project page); your rights to those components are governed by their own licences, which permit reuse.

3. Price and payment

The Software is sold on a “pay what you want” basis with a minimum of US$5. You choose the amount at checkout. The amount you pay does not change the licence or the support you receive; a suggested price of US$49 is shown to reflect the ongoing cost of maintaining the Software.

Payment, checkout, invoicing and tax are handled by Stripe, which acts as the merchant of record for your purchase. Stripe calculates, collects and remits any applicable sales tax, VAT or GST. We never receive or store your card details.

4. Delivery

The Software is delivered digitally and immediately: after payment you are directed to a download page. It is your responsibility to download the file and keep a copy. If your download does not work, contact us and we will resend it.

We may release updates to keep the Software working with new versions of macOS, and provide email support through the contact form. We do not guarantee updates or support for any fixed period, and we may discontinue the Software. Free updates, where released, are provided to existing customers at no additional charge.

7. No warranty

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT, OR ANY WARRANTY THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH ANY FUTURE VERSION OF macOS OR WITH YOUR HARDWARE. You install and use the Software at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Software or these Terms is limited to the amount you actually paid for the Software. We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost or corrupted recordings or data, lost profits, downtime, or damage to hardware or other software, even if we have been advised of the possibility.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under the Québec Consumer Protection Act where it applies to you, or liability for fraud or gross negligence.

9. Acceptable use

You agree not to use the Software unlawfully, not to reverse engineer it in order to build a competing product for redistribution or resale, and not to use it in any way that infringes the rights of Allen & Heath, Ploytec, Apple or any third party.

10. Changes to these Terms

We may update these Terms from time to time. The version published on this page at the time of your purchase governs that purchase. Changes take effect when posted.

11. Governing law

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Subject to any mandatory consumer-protection rules of your place of residence, the courts of Québec, Canada have exclusive jurisdiction over any dispute.
